The European Commission has proposed a Green Claims Directive to combat greenwashing and ensure transparent environmental claims are made by companies operating in the EU.
This directive aims to regulate how companies market their environmental impacts and performance, covering voluntary claims made to EU consumers regarding a product, service, or organisation’s positive environmental effects. It sets minimum norms for substantiating, communicating, and verifying environmental claims. Companies will be prohibited from making claims based on emissions offsetting, effectively banning them. This includes claims of being ’carbon-neutral,’ as such claims are considered greenwashing.

While compliance could be costly, it reduces reputational risks, enhances brand value, and
offers strategic planning benefits. Companies should assess their readiness and consider
potential benefits and challenges, so be aware!

The directive is expected to come into force in early 2024.

Announcement: EU General Product Safety Regulation published

In May 2023, the Regulation (EU) 2023/988 on general product was adopted. It replaces the General Product Safety Directive (GSPD) and is applicable per December 2024. This regulation was a necessity to keep up with changes in technology and consumption as well as improving the recall procedure.

It introduces a harmonized approach to make sure that products consumers buy are safe, closing loopholes that previously enabled non-conformity. Companies acting on the EU market are advised to get familiar with the new rules and start preparing.

Published: Proposal for a Green Claims Directive

In March 2023, the European Commission published a proposal for a Directive on substantiation and communication of explicit environmental claims (Green Claims Directive). The proposal aims to implement a specific directive (regarding voluntary explicit environmental claims) under a more general directive, the Unfair Commercial Practices Directive (regarding all voluntary general claims). It is expected to come into force in 2024.

Updated: UK importer information requirements

Importers of consumer products covered by the 2005 General Product Safety Regulations are required to indicate their name and address (UK based) on the individual product or its packaging. Where this might be difficult, UK government allowed businesses to make use of an alternative method to ensure traceability for the end user and regulator, by including the importer’s address in accompanying documents, such as, shipping documents or invoices to the consumer.

Previously, this alternative approach was time-limited and not allowed after December 2022, but has now been extended until December 31, 2027. Nonetheless, it is advised to already now implement measures ensuring that individual goods carry the importer’s address as required before the new deadline is running out.

Please note that this general requirement as well as its alternative method for disclosure might be overruled by product specific legislation.

The European Green Deal, EU’s roadmap towards circularity and climate neutrality, comprises of different policy initiatives to realize the desired aim of becoming the first climate neutral continent by 2050. Nilörn is continuously monitoring the legal development following the New Circular Economy Action Plan and would like to make you aware of an upcoming legislative act that will have a great impact on the use and presentation of information on the environmental performance of products and businesses.

The aim of the Green Claims initiative is described as to strengthen consumer protection and to reduce the risk of greenwashing by providing companies with clear instructions and uniform rules on how to communicate environmental claims that are reliable, comparable, and verifiable across the EU. This piece of legislation is predicted to define a standard methodology with independent verifiers for the substantiation of environmental claims.
In addition, a restriction for the use of environmental labels based on certification schemes without third party verification is expected.

– Iceland’s rugged landscape forms the inspirational backdrop for this menswear collection. Jörd integrates biobased materials into classic garments that simultaneously recollect and respect nature.

We offer a basic solution of standardized packaging which is branded with a sticker with your logotype. You find corrugated boxes, e-commerce bags in kraft paper and polybags – all with an assortment of different sizes. All paper are FSC certified and plastic bags are GRS certified, printed and compliant with the recycling requirements. Short leadtimes, low minimum quantities and no start up costs.
